45L Federal Tax Credit Update

As part of the large tax and legislation, the “One Big Beautiful Bill,” the GOP-controlled U.S. House voted to eliminate the 45L federal tax credit for energy-efficient homes, effective December 31, 2025. The original expiration date of the credit was 2032.

The legislation has now moved to the U.S. Senate.

RESNET has collaborated with leading builder and rating companies to educate members of the Senate Finance Committee, which oversees tax writing, on the importance of the 45L tax credit to builders and homeowners in their states.

This effort has shown some effect, as the Senate Finance Committee has released its tax provisions of the legislation. In its draft, the Finance Committee extended the expiration of the 45L tax credit from the House’s December 31, 2025, date to “12 months after the date of enactment (of the legislation)”.

RESNET is working with collaborating organizations to possibly extend the credit to December 31, 2026.

Once the Senate Finance Committee formally adopts the language, it will go to the Senate floor. If the Senate adopts the language, it will go back to the House for consideration of the Senate changes. If the House does not adopt the Senate changes, the legislation will go to a conference committee to try to hammer out a bill that both chambers can adopt.
